The CDL Itself Has No Felony Ban
Neither the FMCSA nor Washington State DOL automatically bars individuals with felony records from obtaining a CDL. The licensing test doesn't ask about criminal history. You take the same knowledge exam and skills test as everyone else. Where things get more nuanced is in endorsements and employment — not the license itself.
Endorsement Restrictions
The Hazardous Materials (HazMat) endorsement requires a TSA background check, and certain felony convictions — especially those involving transportation security, arson, terrorism, or certain drug offenses — can result in denial. However, many other endorsements, including tanker and doubles/triples, have no criminal background requirement. A disqualifying HazMat offense doesn't prevent you from driving; it just limits that one endorsement.
Employment Realities
This is where honesty matters. Some major carriers have policies against hiring drivers with certain felony convictions, particularly those involving theft, violence, or drug trafficking. However, many carriers actively hire individuals with records, especially as the driver shortage continues to grow. Smaller and mid-size carriers, local delivery companies, and construction haulers are often more flexible. The type of felony, how long ago it occurred, and your record since then all factor into hiring decisions.
Steps to Improve Your Chances
Keep a clean driving record — this matters as much as your criminal record to most carriers. Complete your CDL training through an accredited school, which demonstrates commitment and discipline. Be upfront with potential employers rather than hoping they won't check. And look into expungement if your state allows it for your specific offense.
